Landmark court decision in Western Australia

In the West Australian Supreme Court, Chief Justice Wayne Martin said the Brightwater Care Group would not be criminally responsible by ceasing nutrition and hydration through a tube to the stomach of Christian Rossiter, a 49-year-old in their care.
Chief Justice Martin also said any person providing palliative care to Mr Rossiter would not be criminally responsible.
He said it was clear Mr Rossiter had the right to direct his treatment and nutrition and hydration “should not be administered against his wishes.”

I agree, a great step forward. I am actually quite surprised with the resut. I am not sure about the legal side of things but wonder if some organisation might challenge the finding.

It’s heartening to see there’s common sense and humanity in our justice system, but it is a pity that Mr Rossiter had to go the legal route to be given by others what should be his own personal right to choose to end his life. still, It’s a big step in the right direction and hopefully this ruling will help the pro-euthenasia debate as now they have a precedent to refer to even if it is a rather extreme case. It’s unusual in that Mr Rossiter is so incapacitated but can be shown to have the mental acuity to make reasoned decisions.
